When does a Goldfish Swim School franchisee's assignment of telephone numbers to Goldfish become effective?

According to the 2025 Goldfish Swim School Franchise Disclosure Document, a franchisee's assignment of telephone numbers to Goldfish Swim School becomes effective upon the expiration without renewal or termination of the Franchise Agreement. This means that once the franchise term ends, either through its natural expiration without an extension or through a termination event as defined in the agreement, the rights to the telephone numbers used for the Goldfish Swim School location transfer to Goldfish Swim School.

Goldfish Swim School will provide written notice to telephone companies and other relevant businesses to recognize the assignment. This notice serves as the franchisee's cancellation and surrender of the numbers, allowing the immediate reassignment of the numbers to Goldfish Swim School. A certified copy of the assignment from a Goldfish Swim School officer is considered as valid as the original document.

The franchisee is obligated to cooperate with Goldfish Swim School to ensure the smooth transfer of telephone numbers, including signing any necessary documents. If the franchisee fails to sign these documents within two business days of notice, Goldfish Swim School is appointed as the franchisee's attorney-in-fact to sign on their behalf. Additionally, telephone charges will be prorated as of the assignment date, with the franchisee responsible for charges up to that point and Goldfish Swim School responsible for subsequent charges.
