What This Means (2025 FDD)
According to the 2025 Goldfish Swim School Franchise Disclosure Document, any disputes arising from the Conditional Assignment of Lease are resolved through arbitration. Specifically, if any disagreement occurs between the parties involved and cannot be settled amicably, the resolution will be determined solely and exclusively through arbitration.
The arbitration process will follow the Commercial Arbitration Rules of the American Arbitration Association. This means that the arbitration will be conducted according to the established procedures and guidelines set forth by this association, which is a common practice in franchise agreements to ensure a structured and impartial resolution process.
Importantly, the arbitration must also be consistent with the Franchise Agreement. This implies that the terms and conditions outlined in the Franchise Agreement will take precedence and guide the arbitration process, ensuring that the resolution aligns with the overall agreement between Goldfish Swim School and the franchisee. This approach provides a defined and potentially less costly method for resolving disputes compared to litigation.
