Does the Goldfish Swim School agreement grant the Developer any rights to the Trademarks?

According to the 2025 Goldfish Swim School Franchise Disclosure Document, the Development Agreement does not grant the Developer any rights to use the Goldfish Swim School trademarks. The agreement solely grants the right to develop and operate swim schools within a specific territory.

Specifically, the Developer cannot sell products or services identified by the trademarks outside of the swim schools within their territory, nor can they sell these items for resale or distribution. The Developer also cannot control Goldfish Swim School's development or operation of franchised, company-owned, or affiliate-owned swim schools outside their designated territory.

Goldfish Swim School retains control over internet advertising and use of the marks online, including websites, domain names, and social media. While the Developer may be asked to provide content for Goldfish Swim School's internet marketing, they must adhere to the franchisor's rules and policies. The franchisor maintains ownership of copyrights for all website material, including content provided by the developer. Upon termination or expiration of the Development Agreement, the developer must also take necessary actions to cancel or assign any assumed name registrations containing Goldfish Swim School's name or trademarks to the franchisor.
