Does Golden Krust Caribbean Restaurant have the obligation to develop software programs for franchisees to use?

According to Golden Krust Caribbean Restaurant's 2024 Franchise Disclosure Document, Golden Krust Caribbean Restaurant does not have the obligation to develop software programs for franchisees. However, Golden Krust Caribbean Restaurant has the right, but not the obligation, to develop or designate software programs for franchisees to use in connection with their computer and POS systems.

If Golden Krust Caribbean Restaurant develops or designates software, franchisees must install all such software, including any updates, supplements, modifications, or enhancements that Golden Krust Caribbean Restaurant requires. Golden Krust Caribbean Restaurant and its suppliers may charge a reasonable software license fee for any required software.

Furthermore, franchisees are required to acquire and install specific point of sale (POS) systems, back-office computers, and other computer equipment and software systems that Golden Krust Caribbean Restaurant specifies in writing. Franchisees must also maintain an electronic connection between their systems and Golden Krust Caribbean Restaurant's systems, use the systems according to issued policies, transmit data as specified, maintain the systems in good working order, and promptly install any hardware or software upgrades as directed. Franchisees must ensure their employees are adequately trained in using these systems and implement necessary security measures.
