- 16.5. Subsequent Use of Marks Prohibited. You agree, in the event you continue to operate or subsequently begin to operate any other business, not to use any reproduction, counterfeit, copy or colorable imitation of the Marks, either in connection with such other business or the promotion thereof, which, in our sole business judgment, is likely to cause confusion, mistake or deception, or which, in our sole business judgment, is likely to dilute our rights in and to the Marks.

What This Means (2024 FDD)
According to the 2024 Gokhale Method Franchise Disclosure Document, if a franchisee continues to operate or begins to operate another business after the termination of the franchise agreement, they are prohibited from using any reproduction, counterfeit, copy, or colorable imitation of the Gokhale Method Marks. This prohibition applies both to the operation of the other business and to its promotion. The determination of what constitutes a prohibited imitation of the Marks rests solely with Gokhale Method.
Furthermore, the franchisee is not allowed to use any designation of origin, description, or representation that suggests a present or former association or connection with Gokhale Method, the Gokhale System, or the Marks. This includes references to the Gokhale Method Institute, the System, or the Marks themselves.
This restriction is designed to prevent confusion, mistake, or deception among consumers and to protect Gokhale Method's rights to its Marks. It ensures that former franchisees do not create the impression that their new or existing businesses are affiliated with or endorsed by Gokhale Method after the franchise agreement has ended. This is a standard practice in franchising to protect brand integrity and prevent unfair competition.
