What This Means (2024 FDD)

According to Gokhale Method's 2024 Franchise Disclosure Document, as a franchisee, you are restricted from engaging in any competitive business during the term of the franchise agreement. Specifically, you are prohibited from diverting or attempting to divert any present or prospective customer, employing or seeking to employ any person employed by Gokhale Method, its affiliates, or any of its franchisees, and from being involved in any Competitive Business. This restriction is detailed in Section 17.1 of the franchise agreement.

This non-compete clause is a standard practice in franchising to protect the franchisor's brand, customer base, and proprietary information. It ensures that franchisees focus solely on growing the Gokhale Method business and do not use their knowledge or resources gained from the franchise to benefit a competing venture. The restriction applies throughout the duration of the franchise term, which is five years, as stated in Section 3.1 of the franchise agreement.

In addition to the non-compete covenant during the franchise term, there are also restrictions in place after the franchise is terminated or expires. For a period of two years following the termination or expiration of the franchise, you cannot be involved in any business that is competitive with Gokhale Method within a 10-mile radius of your former location or any location where the Gokhale System is taught. This post-term non-compete clause further protects Gokhale Method's market share and business interests.

Prospective franchisees should carefully consider these non-compete obligations and how they might impact their future business opportunities. It is important to fully understand the scope and duration of these restrictions before entering into a franchise agreement with Gokhale Method.
