What This Means (2024 FDD)

According to the 2024 Gokhale Method Franchise Disclosure Document, California Business and Professions Code Sections 20000 through 20043 provide rights to the franchisee concerning termination, transfer, or non-renewal of a franchise. This is highlighted in an addendum specifically for the state of California, indicating that California law will take precedence if the franchise agreement contains any provision inconsistent with these sections.

This means that Gokhale Method franchisees in California have certain legal protections related to the circumstances under which their franchise can be terminated, the conditions under which they can transfer their franchise to another party, and their rights regarding the non-renewal of their franchise agreement. These protections are particularly important because franchise agreements often heavily favor the franchisor, and these laws aim to create a more balanced relationship.

Prospective Gokhale Method franchisees in California should carefully review California Business and Professions Code Sections 20000 through 20043 to fully understand their rights. They should also consult with an attorney experienced in franchise law to ensure that the franchise agreement complies with California law and that their interests are adequately protected. This is especially important given that certain provisions in the standard franchise agreement, such as those related to termination upon bankruptcy or covenants not to compete, may not be enforceable under California or federal law.
