What are the legal benefits that Gokhale Method's unregistered trademarks lack compared to federally registered trademarks?

Gokhale_Method Franchise · 2024 FDD

Answer from 2024 FDD Document

We also claim common-law rights to the stylized design of a tree as well as to the words "Primal PostureTM", "Gokhale Pain Free ChairTM", "Pendo PressTM", "SpineTrackerTM", and "PostureTrackerTM" (the "Unregistered Marks") that we use in connection with our trade names. We do not have federal registrations for the Unregistered Marks. Therefore, these trademarks do not have the legal benefits and rights they would have as a federally registered trademark. If our right to use these trademarks is challenged, you may have to change to an alternative trademark, which may increase your expenses.

What This Means (2024 FDD)

According to Gokhale Method's 2024 Franchise Disclosure Document, the company uses both registered and unregistered trademarks. The federally registered trademarks, such as "APLOMB", "POSITIVESTANCE", and "GOKHALE", are registered with the United States Patent and Trademark Office (PTO) and thus have certain presumptive legal rights granted by registration.

However, Gokhale Method also uses unregistered trademarks, including the stylized design of a tree, "Primal PostureTM", "Gokhale Pain Free ChairTM", "Pendo PressTM", "SpineTrackerTM", and "PostureTrackerTM". The FDD states that these unregistered trademarks do not have the same legal benefits and rights as federally registered trademarks.

This distinction is important for prospective Gokhale Method franchisees because it means that the legal protection for these unregistered marks is weaker. If Gokhale Method's right to use these unregistered trademarks is challenged, franchisees may be required to switch to alternative trademarks, potentially increasing their expenses. This highlights a risk for franchisees, as they may incur unforeseen costs related to rebranding if legal challenges arise concerning the unregistered trademarks.
