What This Means (2024 FDD)
According to the 2024 Gokhale Method Franchise Disclosure Document, upon termination of the Franchise Agreement, a franchisee is obligated to cease using any of Gokhale Method's domain names, URLs, email addresses, or home page addresses. Furthermore, the franchisee is prohibited from establishing any website using a domain name, URL, or home page address that is confusingly similar to those of Gokhale Method. This obligation is designed to protect Gokhale Method's brand identity and prevent customer confusion after a franchise agreement ends.
This provision ensures that former franchisees do not unfairly capitalize on the goodwill and brand recognition of Gokhale Method by creating websites that could mislead customers into believing they are still affiliated with the franchise. It is a standard practice in franchising to include such clauses to maintain brand consistency and prevent market confusion.
For a prospective Gokhale Method franchisee, this means that upon termination or expiration of the franchise agreement, they must take immediate steps to remove all references to the Gokhale Method brand from their online presence. This includes not only ceasing the use of existing Gokhale Method web addresses but also refraining from creating new ones that could be deemed confusingly similar. Failure to comply with this provision could result in legal action by Gokhale Method to enforce its trademark and protect its brand.
