What This Means (2024 FDD)
According to the 2024 Gokhale Method Franchise Disclosure Document, if a franchisee operates another business, they are prohibited from using any reproduction, counterfeit, copy, or colorable imitation of the Gokhale Method's Marks. This restriction applies both to the operation of the other business and its promotion. The determination of what constitutes a prohibited imitation rests solely with Gokhale Method.
Additionally, the franchisee cannot use any designation of origin, description, or representation that suggests a present or former association or connection with Gokhale Method, the Gokhale System, or the Marks. This includes references to Gokhale Method Institute, the System, or the Marks themselves.
This provision aims to protect Gokhale Method's brand identity and prevent customer confusion or the dilution of its trademark rights. It ensures that franchisees do not leverage the brand's reputation to benefit other ventures, especially after the franchise agreement ends. Franchisees should seek clarification from Gokhale Method regarding any potential conflicts if they intend to operate other businesses, to ensure compliance and avoid potential legal issues.
