What This Means (2024 FDD)

According to Gokhale Method's 2024 Franchise Disclosure Document, a franchisee must acknowledge that the franchisor retains exclusive rights to communicate with, market to, and maintain relationships with the students that the franchisee teaches. The franchisee is prohibited from contesting these rights or interfering with the franchisor's relationships with students. Furthermore, the franchisee does not have rights to any customers or students.

This means that while a Gokhale Method franchisee has the right to recruit and teach students, the franchisor maintains control over the customer relationships. The franchisor can communicate directly with students, market additional services or products to them, and otherwise manage the relationship.

This arrangement has important implications for a prospective franchisee. While the franchisee is responsible for the day-to-day teaching and student recruitment, they do not have the ability to build long-term equity in their customer base. The franchisor retains the ultimate control over the students, which could impact the franchisee's ability to grow their business independently. A prospective franchisee should consider how this division of rights aligns with their business goals and expectations.
