What This Means (2024 FDD)
According to the 2024 Gokhale Method Franchise Disclosure Document, upon termination or expiration of the Franchise Agreement, a franchisee is required to make modifications or alterations to the location to distinguish it from a Gokhale Method Franchised Business. This includes changing and assigning the telephone number to Gokhale Method. The FDD does not explicitly state the consequences of failing to comply with this requirement.
However, the Franchise Agreement states that the franchisee must comply with all obligations upon termination or expiration of the agreement. Failure to do so could potentially lead to legal action by Gokhale Method to enforce the terms of the agreement. This could involve seeking an injunction to compel the franchisee to assign the telephone number or monetary damages to cover any losses suffered by Gokhale Method as a result of the franchisee's non-compliance.
Prospective franchisees should carefully consider these obligations and the potential consequences of non-compliance before entering into a Franchise Agreement with Gokhale Method. It would be prudent to seek legal counsel to fully understand the implications of these provisions and to negotiate terms that are mutually acceptable.
