What This Means (2025 FDD)

According to the 2025 Focus Cfo Franchise Disclosure Document, franchisees are required to adhere to specific policies and procedures when dealing with clients that necessitate a Business Associate Agreement (BAA). Franchisees are explicitly prohibited from executing a BAA as prepared by the client. Instead, Focus Cfo provides a standard BAA for use in such cases.

To ensure compliance, Focus Cfo has a centralized preparation process for BAAs. Franchisees are only authorized to execute a BAA that has been prepared through this centralized process. Furthermore, when a BAA is required with a client, franchisees must also sign additional documentation for Focus Cfo. This documentation confirms that the franchisee is aware of the BAA's requirements and will consistently comply with Focus Cfo's policies and procedures related to clients with a BAA in place.

This policy underscores the importance Focus Cfo places on data protection and regulatory compliance, particularly concerning sensitive client information. By centralizing the BAA preparation and requiring franchisee acknowledgment, Focus Cfo aims to maintain consistent standards and minimize the risk of non-compliance. This approach protects both the franchisee and the Focus Cfo brand from potential legal and financial repercussions associated with data breaches or violations of privacy regulations.
