What This Means (2025 FDD)
According to the 2025 FDD, Focus Cfo franchisees may face competition from various sources. Specifically, Focus Cfo franchisees should be aware that they will not receive an exclusive territory. This means they may encounter competition from other franchisees operating within the same geographic area. Additionally, Focus Cfo retains the right to establish outlets that they own, which could also compete with franchisees.
Furthermore, Focus Cfo franchisees may face competition from other channels of distribution or competitive brands that Focus Cfo controls. However, the FDD states that Focus CFO does not reserve the right to use other channels of distribution (e.g., virtual services) to perform similar services within a franchisee's territory. Also, neither Focus CFO nor any affiliate plans to operate a business under different trademarks that would sell the same services as Focus CFO.
In practice, this means that while Focus Cfo franchisees have a protected brand, they must be prepared to compete with other franchisees and potentially company-owned outlets within their designated area. The lack of an exclusive territory is a common practice in franchising, as it allows the franchisor to expand the brand's presence more rapidly. However, it also places the onus on the franchisee to effectively market and manage their business to stand out from the competition. Prospective franchisees should carefully consider the competitive landscape in their desired territory and develop a robust business plan to mitigate the risks associated with competition.
