No statement, questionnaire, or acknowledgment signed or agreed to by you in connection with the commencement of the franchise relationship shall have the effect of (i) waiving any claims under any applicable state franchise law, including fraud in the inducement, or (ii) disclaiming reliance on any statement made by Focus CFO, and any franchise seller, or other person acting on behalf of Focus CFO. This provision supersedes any other term of any document executed in connection with the Focus CFO franchise.

What This Means (2025 FDD)
According to Focus Cfo's 2025 Franchise Disclosure Document, signing the Franchisee Disclosure Questionnaire does not waive any claims under applicable state franchise law, including claims of fraud in the inducement. It also does not disclaim reliance on any statement made by Focus Cfo, its franchise sellers, or anyone acting on its behalf. This protection supersedes any other conflicting terms in any document related to the Focus Cfo franchise agreement.
The Franchisee Disclosure Questionnaire itself includes questions for the prospective franchisee to answer, such as whether they have received the Franchise Agreement and the Disclosure Document. By signing the questionnaire, the franchisee is representing that their answers to these questions are truthful and that Focus Cfo can rely on them.
This means that while Focus Cfo uses the questionnaire to gather information and confirm receipt of important documents, franchisees retain their legal rights and protections under franchise law. Franchisees are still able to pursue claims against Focus Cfo for fraud or misrepresentation, regardless of having signed the questionnaire. This is a standard protection in franchising to ensure franchisees are not unknowingly waiving their rights.
