Under what condition is a Focalpoint Coaching franchisee required to pay for specialized Consultation Services from the Franchisor?
Focalpoint_Coaching Franchise · 2025 FDDAnswer from 2025 FDD Document
If Franchisee requests, and Franchisor agrees to provide (subject to Franchisor's availability) either (i) additional guidance, assistance, or training, or (ii) specialized Consultation Services, then Franchisee agrees to pay Franchisor's then applicable charges, including Franchisor's personnel's per diem charges and travel and living expenses. For purposes of this Agreement, "Consultation Services" may include any advice related to the operation of the Franchised Business; on-site reviews of Franchisee's operations and additional training as needed; on-site training for Franchisee (or Franchisee's Managing Owner), Franchisee's Associates, or any of Franchisee's other personnel; off-site sessions; and other specialized assistance.

What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, a franchisee is required to pay for specialized Consultation Services if they request such services from Focalpoint Coaching, and Focalpoint Coaching agrees to provide them, subject to availability. These Consultation Services may include advice related to the operation of the Franchised Business, on-site reviews and additional training, on-site training for the franchisee or their personnel, off-site sessions, and other specialized assistance. In addition to the charges for the Consultation Services, the franchisee also agrees to pay Focalpoint Coaching's then-applicable charges, including personnel's per diem charges and travel and living expenses.
This means that while Focalpoint Coaching may offer general guidance and consultation services as part of the franchise agreement, any additional or specialized support comes at an extra cost to the franchisee. This is a fairly common practice in franchising, where franchisors provide a base level of support but charge extra for services beyond the standard package.
For a prospective Focalpoint Coaching franchisee, this highlights the importance of understanding what is included in the standard franchise agreement and what would be considered "additional" or "specialized" services. It also means budgeting for potential consulting fees and travel expenses for Focalpoint Coaching personnel if the franchisee anticipates needing extra support. Franchisees should inquire about the typical costs associated with these services to better prepare their financial forecasts.
It is important to note that the provision of these services is subject to Focalpoint Coaching's availability, meaning that there is no guarantee that the franchisor will be able to provide the requested assistance. Therefore, franchisees should plan accordingly and potentially seek alternative sources of support if needed.
