Are there any agreements that limit Focalpoint Coaching's right to use the copyrighted materials?

There currently are no effective adverse determinations of the USPTO, the United States Copyright Office, or any court regarding the copyrighted materials. No agreement limits our right to use or allow others to use the copyrighted materials. We do not actually know of any infringing uses of our copyrights that could materially affect your use of the copyrighted materials in any state.

What This Means (2025 FDD)
According to the 2025 FDD, there are no agreements that limit Focalpoint Coaching's right to use or allow others to use the copyrighted materials. Focalpoint Coaching and FocalPoint International claim copyrights in the Operations Manual, advertising and marketing materials, and similar items used in operating Focalpoint Coaching Franchised Businesses.
Focalpoint Coaching specifies that franchisees may only use these copyrighted items as directed while operating their franchised business and must stop using them if instructed to do so. While neither Focalpoint Coaching nor FocalPoint International have registered these copyrights with the United States Registrar of Copyrights, they don't need to do so to protect them.
Focalpoint Coaching retains control over any legal actions related to copyright protection, even if a franchisee brings the matter to their attention. They are not obligated to participate in a franchisee's defense or provide indemnity for damages or expenses in a copyright-related proceeding. This means that while franchisees are granted the right to use the copyrighted materials, Focalpoint Coaching maintains control over their use and protection.
