What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, several consequences may arise if a franchisee fails to pay the training fee. The initial training fee is $16,950 per person for Associates and Business Managers and $5,000 per person for non-coaching personnel. These fees are due immediately upon receipt of the invoice.
If the franchisee does not pay the training fee on time, Focalpoint Coaching can charge interest on all overdue amounts. This interest accrues beginning 15 days after billing and is calculated as the lesser of 1.5% per month or the highest commercial contract interest rate the law allows. Additionally, Focalpoint Coaching may impose a late fee of 18% of the amount owed, also due 15 days after billing, to cover increased administrative costs and expenses associated with the overdue payment.
Beyond these specific fees, Focalpoint Coaching has broader recourse for non-compliance with the Franchise Agreement. The franchisee is responsible for costs and attorneys’ fees incurred by Focalpoint Coaching due to the franchisee's failure to comply with the Franchise Agreement. While the exact amount of these costs and fees will vary depending on the circumstances, this provision allows Focalpoint Coaching to recover expenses associated with enforcing the payment of the training fee or any other breach of the agreement.
Furthermore, if the franchisee has insufficient funds in their Electronic Depository Transfer Account (EDTA) to cover the training fee payment, or if a check is returned due to insufficient funds, Focalpoint Coaching will charge a $100 insufficient funds processing fee. Focalpoint Coaching also requires franchisees to sign documents authorizing them to debit the franchisee's business checking account automatically for the Royalty, Fund contributions, and other amounts due under the Franchise Agreement and for purchases from Focalpoint Coaching and/or its affiliates.
