What This Means (2025 FDD)
According to the 2025 Focalpoint Coaching Franchise Disclosure Document, a franchisee must obtain prior written consent from Focalpoint Coaching before changing their Managing Owner. The Managing Owner is responsible for overseeing and supervising the operation of the franchised business. The identity of the Managing Owner is initially established in Exhibit A of the franchise agreement.
This requirement ensures that Focalpoint Coaching maintains control over who is managing and supervising the franchised business. By requiring prior written consent, Focalpoint Coaching can assess the qualifications and experience of any proposed new Managing Owner to ensure they meet the standards and expectations of the franchise system. This helps protect the brand and maintain consistency across all franchise locations.
For a prospective franchisee, this means that if they wish to change the Managing Owner of their Focalpoint Coaching franchise, they must first seek and receive approval from Focalpoint Coaching. Failure to do so could be a breach of the franchise agreement and could potentially lead to termination of the agreement. It is important for franchisees to carefully consider this requirement and ensure they have a plan in place for managing the business and obtaining any necessary approvals from Focalpoint Coaching.
