What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, certain defaults are considered non-curable and can lead to the termination of the franchise agreement. These include misrepresentation during the franchise acquisition process, failing to open and operate the Franchised Business within 60 days of the Franchise Agreement's Effective Date, and failure to complete the required training.
Additionally, Focalpoint Coaching may terminate the franchise agreement if a franchisee abandons the business, engages in unapproved transfers of the franchise, or is convicted of a felony crime or other offense. Dishonest or unethical conduct, making illicit statements (including via email or social media) that negatively affect Focalpoint Coaching, and unauthorized use or disclosure of the Operations Manual or other confidential information are also non-curable defaults.
Other non-curable defaults include failure to pay taxes or amounts owed to clients, FocalPoint Coaching franchise owners, or third parties. Repeated defaults, even if cured, can also lead to termination. Engaging in activities such as violating anti-terrorism laws, knowingly maintaining false books or records, refusing inspections, or contacting Brian Tracy or Campbell Fraser (or their employees/affiliates) without prior written consent are also grounds for termination. Finally, misrepresentation or failure to disclose material information to a governmental authority regarding the Franchised Business is a non-curable default.
