We may designate a separate entity as we deem appropriate in our sole discretion to operate and administer the Fund. Any such entity will have all of the rights and duties described here.

What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, Focalpoint Coaching has the authority to designate a separate entity to manage the Advertising and Development Fund. The FDD states that Focalpoint Coaching may designate a separate entity to operate and administer the Fund as they deem appropriate. This designated entity will then assume all the rights and responsibilities associated with the Fund's operation.
This means that Focalpoint Coaching franchisees may not directly interact with Focalpoint Coaching regarding the advertising fund, but instead with this separate entity. This entity would be responsible for managing the fund's assets, collecting contributions, and directing advertising and marketing programs.
Focalpoint Coaching retains control over the Fund's direction, including creative concepts, materials, and media placement, regardless of whether it's managed directly or by a separate entity. The FDD also specifies that the successor entity will have all of the rights and duties described in the FDD.
