Before this Agreement is executed, Franchisor will describe the Territory in Exhibit B. The size of the Territory shall be determined in Franchisor's sole discretion. Franchisee's rights in the Territory during the term of this Agreement are non-exclusive and Franchisee may face competition from Franchisor or other FocalPoint Franchised Businesses. Franchisee must advertise and solicit clients for the Franchised Business only within the Territory. What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, the description of the franchisee's territory will be found in Exhibit B of the Franchise Agreement before the agreement is executed. The size of the territory is determined at the sole discretion of Focalpoint Coaching.
It is important to note that the franchisee's rights within the territory are non-exclusive, meaning that the franchisee may face competition from Focalpoint Coaching itself or other Focalpoint Coaching franchised businesses. Despite the non-exclusive nature, the franchisee is required to focus their advertising and client solicitation efforts within their designated territory.
While franchisees must generally operate and provide services within their territory, there are exceptions. A Focalpoint Coaching franchisee may provide services to clients outside their territory if the client is a personal acquaintance, was referred to the franchisee, or resulted from the franchisee's indirect marketing efforts through digital media. This allows for some flexibility in serving clients beyond the defined geographical boundaries.
