Advertising and Development Fund
We have established a formal Advertising and Development Fund (the "Fund") for advertising, marketing, and public relations programs and materials we deem appropriate. We may designate a separate entity as we deem appropriate in our sole discretion to operate and administer the Fund. Any such entity will have all of the rights and duties described here. You must contribute to the Fund the amounts that we periodically require, not to exceed $150 per month, plus an additional $150 per month for each Associate you retain or hire (currently, $150 plus $150 per Associate per month). What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, franchisees must contribute to the Advertising and Development Fund. The contribution is capped at $150 per month. Additionally, franchisees must contribute an extra $150 per month for each associate they employ. Therefore, the total monthly contribution is $150 plus $150 for each associate.
The purpose of this fund is for advertising, marketing, and public relations programs and materials that Focalpoint Coaching deems appropriate. The franchisor has sole discretion over how the fund is administered and spent, including creative concepts, materials, endorsements, and their placement. The FDD specifies that Focalpoint Coaching may use the fund to grow the number of Focalpoint Coaching Franchised Businesses.
Focalpoint Coaching can modify or suspend these contributions with 30 days' notice. If the fund is terminated, the remaining money will be distributed to franchise owners, Focalpoint Coaching, and its affiliates based on their contributions over the previous 12 months. This structure is fairly typical in franchising, where advertising funds are used to promote the brand as a whole, although the specific contribution amounts and the degree of franchisor control can vary significantly.
