What This Means (2025 FDD)
According to the 2025 Focalpoint Coaching Franchise Disclosure Document, the restrictions on involvement in a Competitive Business after termination or expiration extend beyond just the franchisee. Specifically, these restrictions can apply to members of the franchisee's Immediate Family.
The FDD defines "Immediate Family" as one or more of a franchisee's spouse, legally-recognized domestic partner, parents, children, or siblings. These individuals are restricted from owning a legal or beneficial interest in, or rendering services or giving advice to, any Competitive Business for a period of two years after the termination or expiration of the franchisee's relationship with Focalpoint Coaching.
The restrictions apply to Competitive Businesses operating in specific locations: the premises where the Focalpoint Coaching office was located, within the territory granted to the franchisee, within a 25-mile radius of that territory, or within the territory of any other Focalpoint Coaching franchise in operation or under construction at the time of termination. The restrictions also extend to any entity that grants franchises or licenses to others to operate any Competitive Business. This broad definition aims to prevent both direct and indirect competition with Focalpoint Coaching after the franchise agreement ends.
