How does Focalpoint Coaching advise franchisees regarding the operation of the Franchised Business?

During your operation of the Franchised Business, we (and/or an Area Representative operating in the Territory) will:

    1. Advise you regarding the Franchised Business' operation based on your reports or our inspections. We also will guide you on standards, specifications, and operating procedures and methods that FocalPoint Franchised Businesses use; purchasing required and authorized Operating Assets, Proprietary Products, and other items and arranging for their distribution to you; advertising and marketing materials and programs; employee training; and administrative, bookkeeping, and accounting procedures. We will guide you in our Operations Manual, bulletins, or other written materials; by electronic media; by telephone consultation; and/or at our office or the Office.     1. Give you, at your request (and our option), additional or special guidance, assistance, and training. (Franchise Agreement − Section 4.) (See Item 6)
    1. Continue to provide you access to one copy of the Operations Manual, which could include audiotapes, videotapes, compact disks, computer software, other electronic media, and/or written materials. The Operations Manual contains mandatory and suggested specifications, standards, operating procedures, and rules ("System Standards") that we periodically require. We may modify the Operations Manual periodically to reflect changes in System Standards. (Franchise Agreement − Sections 4.D. and 8)

    1. Issue and modify System Standards for FocalPoint Franchised Businesses. We periodically may modify System Standards, which may accommodate regional or local variations, and these modifications may require you to invest additional capital in the Franchised Business and/or incur higher operating costs.     1. Establish, to the fullest extent allowed by applicable law, maximum, minimum, or other pricing requirements with respect to the prices you may charge for products and services. (Franchise Agreement - Section 8.E.)
    1. Inspect the Office and observe the Franchised Business' operation to help you comply with the Franchise Agreement and all System Standards. If we inspect the Office, we will not interfere unreasonably with the Franchised Business' operation, and if your Office is located in a residence, we will only conduct an inspection if you host clients at the Office. Initial Marketing Fee

You must pay us the Initial Marketing Fee in the amount of $2,950 in a lump sum when you sign the Franchise Agreement. You must pay us an additional Initial Marketing Fee for each Associate you retain or hire.

What This Means (2025 FDD)

According to Focalpoint Coaching's 2025 Franchise Disclosure Document, Focalpoint Coaching provides guidance to franchisees on operating their franchised business through several methods. Focalpoint Coaching will advise franchisees based on their submitted reports or inspections conducted by Focalpoint Coaching. This includes guidance on standards, specifications, operating procedures, and methods used within the Focalpoint Coaching franchise system. They also provide guidance on purchasing required operating assets, proprietary products, and other necessary items, as well as arranging for their distribution. Franchisees will also receive support regarding advertising and marketing materials and programs, employee training, and administrative, bookkeeping, and accounting procedures. This guidance is delivered through the Operations Manual, bulletins, written materials, electronic media, telephone consultations, and/or at Focalpoint Coaching's office.

Focalpoint Coaching also offers additional or special guidance, assistance, and training at the franchisee's request, subject to Focalpoint Coaching's discretion. Franchisees will have continuous access to the Operations Manual, which may include various media formats such as audiotapes, videotapes, compact disks, computer software, electronic media, and written materials. The Operations Manual contains mandatory and suggested specifications, standards, operating procedures, and rules, referred to as "System Standards," which Focalpoint Coaching may periodically modify to reflect changes in the system.

Focalpoint Coaching will also issue and modify System Standards for Focalpoint Coaching Franchised Businesses, which may accommodate regional or local variations. These modifications may require franchisees to invest additional capital in the Franchised Business and/or incur higher operating costs. Focalpoint Coaching may also establish, to the fullest extent allowed by applicable law, maximum, minimum, or other pricing requirements with respect to the prices franchisees may charge for products and services. They will also inspect the Office and observe the Franchised Business' operation to help franchisees comply with the Franchise Agreement and all System Standards. Franchisees are also allowed to use Focalpoint Coaching's confidential information and Marks. Focalpoint Coaching also periodically offers refresher training courses.
