What This Means (2025 FDD)
According to Focalpoint Coaching's 2025 Franchise Disclosure Document, the Advertising and Development Fund can be used for the development and maintenance of an electronic commerce website. The Fund is used for advertising, marketing, and public relations programs and materials.
The franchisor, or a designated advertising agency, has sole control over the creative concepts, materials, and endorsements used, including their placement and allocation. The Fund's resources may be allocated to various activities, including the creation of video, audio, written, and electronic media, as well as the development, implementation, and maintenance of an electronic commerce website and related strategies.
This means that Focalpoint Coaching franchisees benefit from a centralized fund that supports a range of advertising and marketing efforts, including maintaining an online presence. The franchisor has the discretion to determine how the funds are spent, but the FDD specifies that website development is an allowable use. This centralized approach can help ensure brand consistency and potentially provide franchisees with a more effective online presence than they could achieve on their own.
However, franchisees do not have direct control over how the Fund is spent, and the franchisor is not obligated to ensure that expenditures in any geographic area are proportionate to contributions from franchisees in that area. Franchisees are also prohibited from creating their own websites that mention or describe the Franchised Business or display any of the Marks.
