What This Means (2025 FDD)
According to the 2025 Focalpoint Coaching Franchise Disclosure Document, Focalpoint Coaching acknowledges that the Franchisor has the right to restrict the franchisee's sources of proprietary products. Additionally, the franchisor retains the right to restrict the franchisee's sources for other goods and services. This is further detailed in various sections of the agreement, including Subsection 8.B.
This provision means that as a Focalpoint Coaching franchisee, your ability to choose suppliers for certain products and services necessary for your business operations may be limited. While the franchisor will likely approve some suppliers, they are under no obligation to approve any new supplier, product, or service that a franchisee proposes. This control allows Focalpoint Coaching to maintain quality and consistency across all franchise locations.
Furthermore, Focalpoint Coaching reserves the right to periodically re-inspect the facilities and products of any approved supplier or distributor and to revoke their approval if they no longer meet the franchisor's criteria. They also reserve the right to charge manufacturers or suppliers a royalty for the right to manufacture products for use in a Focalpoint Coaching franchise. Therefore, franchisees need to be aware of these restrictions and potential costs when planning their business operations.
