What This Means (2024 FDD)

According to Fly To Fit's 2024 Franchise Disclosure Document, franchisees are required to acquire and use all software and related systems as mandated by Fly To Fit. This obligation is outlined in Section 7.7 of the franchise agreement, emphasizing the franchisee's responsibility to comply with Fly To Fit's technology requirements. Franchisees must also enter into any subscription and support agreements that Fly To Fit requires, ensuring ongoing maintenance and updates for the software.

The FDD specifies that franchisees are responsible for upgrading, updating, or replacing software as directed by Fly To Fit, ensuring that the technology used in the business remains current and aligned with the franchisor's standards. Furthermore, franchisees must protect the confidentiality and security of all software systems and adhere to any System Standards related to these systems. This includes providing Fly To Fit with unlimited access to the franchisee's point of sale system and other software systems used in the business, by any means designated by Fly To Fit.

The System Standards definition includes a detailed list of technology requirements, such as computers, computer peripheral equipment, smartphones, point-of-sale systems, back-office systems, information management systems, security systems, video monitors, other software, backup and archiving systems, communications systems (including email, audio, and video systems), payment acceptance systems, and internet access, as well as upgrades, supplements, and modifications thereto. This broad definition ensures that franchisees maintain a consistent and up-to-date technology infrastructure across all Fly To Fit locations, which is a common practice in franchising to maintain brand consistency and operational efficiency.
