What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, Fly To Fit has specific rights regarding any innovations developed by a franchisee, its employees, agents, or contractors related to the Fly To Fit business. The franchise agreement stipulates that franchisees must disclose all ideas, plans, improvements, concepts, methods, and techniques pertaining to the business to Fly To Fit. These are collectively termed "Innovations."
Upon disclosure, Fly To Fit automatically owns all such Innovations. This ownership grants Fly To Fit the right to use and incorporate any of these Innovations into the Fly To Fit system without providing any compensation to the franchisee who developed them. This means that any improvements or new ideas a franchisee comes up with immediately become the property of Fly To Fit, which can then implement them across the entire franchise system without any additional payment to the originating franchisee.
Furthermore, the franchisee is obligated to execute any documents reasonably requested by Fly To Fit to formally document Fly To Fit's ownership of these Innovations. This ensures that Fly To Fit has the legal documentation necessary to protect its ownership and use of the Innovations. This clause underscores the importance for potential franchisees to understand that any creative or innovative contributions they make to the business model will become the property of the franchisor, with no guarantee of direct benefit or compensation to the franchisee.
