What This Means (2024 FDD)

The 2024 Fly To Fit Franchise Disclosure Document (FDD) does not explicitly state that Fly To Fit is obligated to protect its copyrights. However, the agreement emphasizes Fly To Fit's ownership and control over its trademarks, service marks, and logos, collectively referred to as the "Marks." Franchisees are only authorized to use these Marks in compliance with the franchise agreement, and all goodwill associated with their use inures exclusively to Fly To Fit's benefit. This suggests that Fly To Fit has a vested interest in protecting its intellectual property.

Furthermore, the FDD states that upon termination or expiration of the franchise agreement, the franchisee must return all materials containing any Marks, copyrights, and other proprietary items to Fly To Fit. The franchisee must also delete all confidential information and proprietary materials from electronic devices. This obligation underscores the importance of Fly To Fit's intellectual property and the franchisee's responsibility to protect it during and after the franchise term.

While the FDD does not explicitly outline Fly To Fit's obligation to protect its copyrights, the provisions regarding the use and ownership of Marks, as well as the requirements upon termination, imply that Fly To Fit takes its intellectual property rights seriously. A prospective franchisee should seek clarification from Fly To Fit regarding their specific policies and actions related to copyright protection to fully understand the franchisor's commitment in this area.
