What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, there are specific methods for delivering notices under the franchise agreement. Generally, any notice must be in writing and delivered to the franchisee's address on the Summary Page or to Fly To Fit at 1814 Central Ave, Albany, NY 12205. A party can change their address by providing notice of the new address.
For standard notices, effective delivery requires: personal delivery, registered or certified U.S. mail with return receipt requested, or overnight courier. The notice is considered effective upon receipt or first rejection.
However, there's an exception: Fly To Fit can use electronic mail or other electronic communication to amend the Manual, give binding notice of changes to System Standards, and deliver notices of default. This provides Fly To Fit with more flexible and immediate communication options for certain types of important notices.
