Fit Franchise conducted the audit because Franchisee failed to submit required reports or was otherwise not in compliance with the System, or (ii) the audit reveals that Franchisee understated Gross Sales by 3% or more for any 4-week period.
ARTICLE 11. FRANCHISOR RIGHTS
- 11.1 Manual; Modification. The Manual, and any part of the Manual, may be in any form or media determined by Fly To Fit Franchise. Fly To Fit Franchise may supplement, revise, or modify the Manual, and Fly To Fit Franchise may change, add or delete System Standards at any time in its discretion. Fly To Fit Franchise may inform Franchisee thereof by any method that Fly To Fit Franchise deems appropriate (which need not qualify as "notice" under Section 18.9). In the event of any dispute as to the contents of the Manual, Fly To Fit Franchise's master copy will control.
- 11.2 Inspections. Fly To Fit Franchise may enter the premises of the Business from time to time during normal business hours and conduct an inspection. Franchisee shall cooperate with Fly To Fit Franchise's inspectors.

What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, the 'Manual' contains the methods, procedures, and standards for operating a Fly To Fit business. Fly To Fit will make the Manual available to the franchisee. The manual may be in any form or media determined by Fly To Fit.
Fly To Fit has the right to supplement, revise, or modify the Manual, and change, add, or delete System Standards at any time. Fly To Fit Franchise can inform the franchisee of these changes through any method they deem appropriate. In the event of a dispute, Fly To Fit's master copy of the Manual will control.
The franchisee is required to ensure that their personnel comply with the dress attire, uniform, personal appearance, and hygiene standards outlined in the Manual. Fly To Fit may also amend the Manual and give binding notice of changes to System Standards via electronic mail or other electronic communication.
