What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, Item 1 does not include all laws that may apply to a Fly To Fit business. The FDD emphasizes that franchisees are responsible for understanding and complying with all applicable laws and regulations, regardless of any advice provided by Fly To Fit. Franchisees should also be aware of pending legislation that could affect their Fly To Fit business in the future. It is crucial for prospective franchisees to consult with a legal advisor to determine which requirements apply to their specific Fly To Fit business. Failure to comply with laws and regulations constitutes a material breach of the Franchise Agreement.
Fly To Fit franchisees must secure and maintain all necessary permits, licenses, certifications, and other authorizations required to operate their Fly To Fit business. This includes investigating the availability and requirements for obtaining these items and understanding the associated costs of compliance. Fly To Fit strongly advises consulting with local legal counsel regarding all applicable laws and regulations.
Fly To Fit franchisees must adhere to national, state, and local regulations applicable to all businesses, such as the Americans With Disabilities Act, wage and hour laws, and business licensing requirements. Because Fly To Fit franchisees accept credit cards, they must also comply with general laws and regulations related to credit card acceptance, including the Payment Card Industry ("PCI") Data Security Standard ("DSS"). Franchisees are responsible for PCI DSS compliance and must also comply with data privacy laws for safeguarding member information and regulations for electronic marketing, such as faxes, emails, text messaging, and telemarketing.
