What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, if a franchisee signs a Multi-Unit Development Agreement, Fly To Fit will approve the location of future sites and territories for those sites. The FDD specifies that Fly To Fit's then-current standards for sites and territories will apply. Fly To Fit is not obligated to further assist the franchisee in locating a site or negotiating the purchase or lease of the site.
Before opening a Fly To Fit business, the franchisee must submit potential locations to Fly To Fit for review and advice. The site is subject to Fly To Fit's approval, and the franchisee must provide all required information and documents about the site. Fly To Fit will consider factors such as general location and neighborhood, competition, trade area demographics, traffic patterns, parking, size, physical characteristics of existing buildings, and lease terms when approving sites.
The time limit for Fly To Fit to approve or disapprove a proposed site is 30 days after the franchisee submits all required documents and information. If Fly To Fit and the franchisee cannot agree on a site, the franchisee will be unable to comply with their obligation to develop and open the franchise by the deadline stated in the franchise agreement, potentially leading to default and termination of the agreement unless an extension is agreed upon.
