What This Means (2024 FDD)
According to the 2024 Fly To Fit Franchise Disclosure Document, the Leased Premises must be used only for the operation of a Fly To Fit business. The franchisee, as the tenant, is explicitly restricted to operating only the Fly To Fit business (or any name authorized by Fly To Fit) at the Leased Premises.
This restriction ensures that the franchisee focuses solely on developing and maintaining the Fly To Fit brand and business model at the specified location. It prevents the franchisee from diverting resources or attention to other business ventures that could potentially compete with or detract from the Fly To Fit business. This is a fairly standard clause in franchise agreements, as franchisors want to maintain brand consistency and prevent conflicts of interest.
The landlord is required to provide Fly To Fit with copies of any default notices given to the franchisee and grants Fly To Fit the option to cure any default under the lease within 10 days after the period in which the franchisee may cure the default. If the landlord terminates the lease due to the franchisee's default, Fly To Fit has the option to enter into a new lease with the landlord on the same terms and conditions as the terminated lease, provided Fly To Fit notifies the landlord within 15 days after receiving notice of the termination. This arrangement protects Fly To Fit's interest in maintaining a presence at the location.
Furthermore, if the Franchise Agreement between Fly To Fit and the franchisee is terminated, the franchisee must assign the lease to Fly To Fit upon written request. The landlord consents to this assignment. Fly To Fit also has the right to assign or sublet the lease to another Fly To Fit franchisee. Any lease provision limiting the franchisee's right to own or operate other Fly To Fit outlets in proximity to the Leased Premises does not apply to Fly To Fit itself. This allows Fly To Fit greater flexibility in managing its franchise network.
