What This Means (2024 FDD)

According to Fly To Fit's 2024 Franchise Disclosure Document, Fly To Fit may set minimum qualifications for categories of employees employed by the franchisee. However, the franchisee is solely responsible for the terms and conditions of employment, including recruiting, hiring, training, scheduling, supervising, compensation, and termination. The franchisee is also solely responsible for all actions of its personnel. Fly To Fit and the franchisee are not joint employers, and no employee of the franchisee will be an agent or employee of Fly To Fit.

Within seven days of Fly To Fit's request, the franchisee and each of its employees will sign an acknowledgment form stating that the franchisee alone (and not Fly To Fit) is the employee's sole employer. The franchisee will use its legal name on all documents with its employees and independent contractors, including employment applications, time cards, pay checks, and employment and independent contractor agreements, and the franchisee will not use the Marks on any of these documents.

Fly To Fit also provides suggested staffing levels and guidelines for hiring employees, but all hiring decisions and conditions of employment remain the franchisee's sole responsibility. Fly To Fit may also require the Principal Executive or other employees to complete training programs, for which Fly To Fit may charge a reasonable fee. If travel is required for training, the franchisee is responsible for all travel, living, and other expenses.
