- 15.1 By Fly To Fit Franchise. Fly To Fit Franchise may transfer or assign this Agreement, or any of its rights or obligations under this Agreement, to any person or entity, and Fly To Fit Franchise may undergo a change in ownership and/or control, without the consent of Franchisee.

What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, Fly To Fit does not need the franchisee's consent to transfer the agreement or undergo a change in ownership. Specifically, Fly To Fit Franchise has the right to transfer or assign the Franchise Agreement, including its rights and obligations, to any person or entity without obtaining the franchisee's consent. This also applies to changes in Fly To Fit's ownership or control.
This provision grants Fly To Fit significant flexibility in managing its business and potentially undergoing mergers, acquisitions, or other ownership changes without needing to seek approval from individual franchisees. For a prospective franchisee, this means they have no say in who owns or controls the Fly To Fit franchise system.
While Fly To Fit does not require franchisee consent for its own transfers, the franchisee faces several requirements and restrictions if they wish to transfer their franchise. The franchisee must provide Fly To Fit with at least 60 days' notice and obtain Fly To Fit's consent, which may be subject to various conditions, including the payment of a $10,000 transfer fee plus other costs, the assignee meeting Fly To Fit's standards, and the execution of Fly To Fit's current franchise agreement form.
