5.4 Pre-Opening Assistance.
- (a) Selecting Location. Fly To Fit Franchise shall provide its criteria for Fly To Fit locations to Franchisee. Fly To Fit Franchise will review and advise Franchisee regarding potential locations submitted by Franchisee.
- (b) Pre-Opening Plans, Specifications, and Vendors. Within a reasonable period of time after the Effective Date, Fly To Fit Franchise shall provide Franchisee with (i) Fly To Fit Franchise's sample set of standard building plans and specifications and/or standard recommended floor plans; (ii) the applicable System Standards, (iii) other specifications as Fly To Fit Franchise deems appropriate (which may include specifications regarding inventory, supplies, materials, and other matters), and (iv) Fly To Fit Franchise's lists of Approved Vendors and/or Required Vendors.

What This Means (2024 FDD)
According to Fly To Fit's 2024 Franchise Disclosure Document, Fly To Fit will provide its criteria for Fly To Fit locations to franchisees. Franchisees are responsible for finding a potential location within their Development Area, as described on the Summary Page, and submitting it to Fly To Fit for acceptance along with any related information Fly To Fit may request. If Fly To Fit does not accept the proposed location in writing within 30 days, it is considered rejected. When Fly To Fit accepts a location, it will issue a Location Acceptance Letter, which includes the location and territory. Fly To Fit determines the territory in its discretion, substantially in accordance with Item 12 of the Franchise Disclosure Document.
Fly To Fit's advice or acceptance of a site does not guarantee the business's success, and Fly To Fit assumes no liability regarding the location of the business. Franchisees must submit any proposed lease to Fly To Fit for written approval if requested. The lease term, including renewals, must be no less than the term of the Franchise Agreement. Franchisees must also use commercially reasonable efforts to obtain the landlord's signature on a lease rider required by Fly To Fit.
Franchisees are responsible for constructing or remodeling the location to meet Fly To Fit's System Standards. If required by Fly To Fit, franchisees must engage a licensed architect in the location's jurisdiction. Franchisees cannot begin construction or remodeling without Fly To Fit's approval of their plans. Fly To Fit may inspect the construction or remodeling progress but is not required to do so. Franchisees cannot rely on information or opinions from Fly To Fit or its representatives regarding architectural, engineering, or legal matters, and Fly To Fit assumes no liability in these areas.
