To simplify the language in this disclosure document, the terms "Franchisor", or "we" or "us" means Fly Fitness Franchise, L.L.C., the Franchisor. The terms "we", "us" and "Franchisor" do not include you, the "Franchisee". We refer to the purchaser(s) of a Fly Fitness franchise, as "you" or "Franchisee", whether an individual, a partnership, corporation, or limited liability company. If you are a corporation, partnership or other entity, our Franchise Agreement also will apply to your owners, officers, and directors. If you are married and your spouse is not a partner in the franchise business, certain provisions of our Franchise Agreement will also apply to that spouse.
We were formed as a limited liability company in the State of Nebraska on October 6, 2021. Our principal business address is 201 N 13th Street, Lincoln, Nebraska 68502. We do business under our company name, "Fly Fitness" and its associated design (the "Marks"). We only offer franchises that operate under the "Fly Fitness" Mark. We began offering franchises on June 10, 2022.

The franchise offered is for the right to operate a boutique fitness studio under the "Fly Fitness" Mark. Additionally, Fly Fitness operates four outlets in Nebraska and North Dakota using the trade name "Fly Fitness" and the Marks. Therefore, franchisees can expect to operate their business under the Fly Fitness name and associated branding.
Fly Fitness emphasizes that the distinguishing characteristics of the Franchised Business include their proprietary instructional methods, tools, equipment, distinctive interior and exterior design, décor, color schemes, advertising and marketing specifications. These elements are part of the "System" that franchisees will use to operate their Fly Fitness outlets. This means franchisees must adhere to Fly Fitness's standards for branding and operations.
Prospective franchisees should note that Fly Fitness also offers multi-unit development agreements, allowing qualified individuals to open a minimum of three Fly Fitness outlets in a designated area. Each Franchised Business developed under the multi-unit development agreement requires signing the then-current form of franchise agreement, which may differ from the agreement included in the Franchise Disclosure Document. This highlights the importance of reviewing the most current agreement when expanding with multiple units.
