What This Means (2024 FDD)
According to Fly Fitness's 2024 Franchise Disclosure Document, the franchisor will provide franchisees access to the Confidential Operations Manual and other written materials, which may be provided electronically or via the Internet, at the franchisor's discretion. However, a franchisee may request a physical copy of the Manual if they lose or misplace their original copy. In such cases, Fly Fitness, in its discretion, may provide a physical copy. The franchisee is responsible for paying the then-current replacement fee for the manual.
This policy has a few implications for prospective Fly Fitness franchisees. First, franchisees should be aware that the primary means of accessing the operations manual is likely to be electronic. Franchisees should ensure they have the necessary technology and internet access to utilize the electronic manual effectively. Second, franchisees should take precautions to protect their copy of the manual, whether electronic or physical, to avoid incurring replacement fees.
Finally, the fact that Fly Fitness retains the discretion to provide a physical copy means that franchisees are not automatically entitled to a replacement. Franchisees should confirm the current replacement fee and the process for requesting a physical copy with Fly Fitness before signing the Franchise Agreement.
