Does Fly Fitness provide samples of advertising and promotional materials to franchisees?

You may develop advertising materials for your own use at your own cost, and you may use marketing materials that we may offer to you from time to time. You may not use any advertising or marketing materials, including press releases, unless they have been approved in advance in writing by us, which approval may be withheld in our discretion. We will respond to your request for approval within ten (10) business days; however, if we do not respond within ten (10) business days, the proposed advertising or marketing material is deemed "disapproved".

What This Means (2024 FDD)
According to Fly Fitness's 2024 Franchise Disclosure Document, franchisees may use marketing materials that Fly Fitness offers from time to time. However, franchisees must obtain written approval from Fly Fitness before using any advertising or marketing materials, including press releases. Fly Fitness will respond to the franchisee's request for approval within ten business days. If Fly Fitness does not respond within the specified timeframe, the proposed advertising or marketing material is considered disapproved.
Fly Fitness requires franchisees to spend a minimum of $15,000 on opening advertising and promotional activities within six weeks before and two months after the franchise opens. After that initial period, franchisees must spend at least $500 per month on local advertising. Fly Fitness retains the right to increase the local advertising contribution by 10% annually. Franchisees must provide quarterly reports and documentation of their local advertising expenditures upon request. Fly Fitness also has the option to collect grand opening and local advertising funds to implement advertising campaigns on behalf of the franchisee.
Fly Fitness does not provide for placement of local advertising on behalf of franchisees and has no obligation to spend any amount on advertising in the franchisee's area or territory. Franchisees are responsible for local advertising placement and must list the franchised business in local business directories and establish a social media presence on platforms like Instagram and Facebook, adhering to Fly Fitness's brand standards.
Fly Fitness franchisees are also required to contribute 2% of their weekly Gross Revenue to the Brand Fund, which Fly Fitness administers. These funds can be used for various advertising, marketing, and promotional activities, including the development and placement of advertising materials, marketing seminars, market research, and website maintenance. The Brand Fund will not be used for Fly Fitness's general operating expenses or to solicit new franchise sales, although Fly Fitness reserves the right to include franchise availability information in advertising produced with Brand Fund contributions.
