To simplify the language in this disclosure document, the terms "Franchisor", or "we" or "us" means Fly Fitness Franchise, L.L.C., the Franchisor. The terms "we", "us" and "Franchisor" do not include you, the "Franchisee". We refer to the purchaser(s) of a Fly Fitness franchise, as "you" or "Franchisee", whether an individual, a partnership, corporation, or limited liability company. If you are a corporation, partnership or other entity, our Franchise Agreement also will apply to your owners, officers, and directors. If you are married and your spouse is not a partner in the franchise business, certain provisions of our Franchise Agreement will also apply to that spouse.
We were formed as a limited liability company in the State of Nebraska on October 6, 2021. Our principal business address is 201 N 13th Street, Lincoln, Nebraska 68502. We do business under our company name, "Fly Fitness" and its associated design (the "Marks"). We only offer franchises that operate under the "Fly Fitness" Mark. We began offering franchises on June 10, 2022.
The principal business addresses of our agents for service of process are shown on Exhibit A.

What This Means (2024 FDD)
According to Fly Fitness's 2024 Franchise Disclosure Document, the company operates under its company name, "Fly Fitness," and its associated design, which are collectively referred to as "the Marks." Fly Fitness exclusively offers franchises that operate under the "Fly Fitness" Mark. This means that all franchised businesses must use the Fly Fitness name and associated design elements in their operations.
Fly Fitness grants franchises for the right to operate a boutique fitness studio concept, offering group fitness classes, semi-private sessions, and private sessions. These services are provided under the "Fly Fitness" Mark, utilizing the franchisor's operating procedures and standards. The distinguishing characteristics of the franchised business include proprietary instructional methods, tools, equipment, distinctive interior and exterior design, décor, color schemes, advertising and marketing specifications, and other standards, techniques, and procedures designated for developing, operating, and managing Fly Fitness outlets, all of which constitute the Fly Fitness "System."
Fly Fitness also operates four of its own outlets in Nebraska and North Dakota through its affiliates. These outlets operate using both the trade name "Fly Fitness" and the Marks. This indicates that the company-owned locations adhere to the same branding and operational standards as the franchised locations, ensuring consistency across all Fly Fitness businesses.
