What is the geographic scope of a Fly Fitness franchisee's local advertising?

Fly_Fitness Franchise · 2024 FDD

Answer from 2024 FDD Document

You may only solicit sales from customers in your Territory. You may not use Alternative Distribution Channels, such as the Internet, catalog sales, telemarketing, or other direct marketing to make sales outside your Territory; however, we will include a listing on our website of your Fly Fitness outlet location. Your local advertising must target customers in your Territory, although the reach of your local advertising may extend beyond your Territory.

What This Means (2024 FDD)

According to Fly Fitness's 2024 Franchise Disclosure Document, a franchisee's local advertising must target customers within their designated territory. While the primary focus is on reaching customers within the territory, the FDD clarifies that the reach of the local advertising efforts may extend beyond the boundaries of the territory. This means Fly Fitness franchisees should concentrate their advertising on their local territory but are not strictly limited to it.

This flexibility allows franchisees to capture potential customers who may live just outside the territory but still frequent the area or are likely to use the Fly Fitness services. It is important for franchisees to understand the demographics and customer base in and around their territory to optimize their advertising spend.

However, franchisees are explicitly restricted from using alternative distribution channels like the Internet, catalog sales, or telemarketing to solicit sales outside their territory. The franchisor will include a listing of the franchisee's Fly Fitness outlet location on their website. This ensures that while franchisees can't directly target customers outside their territory through these channels, potential customers can still find their location through the official Fly Fitness website.
