Must a Fly Fitness franchisee's local advertising target customers in their territory?

Fly_Fitness Franchise · 2024 FDD

Answer from 2024 FDD Document

You may only solicit sales from customers in your Territory. You may not use Alternative Distribution Channels, such as the Internet, catalog sales, telemarketing, or other direct marketing to make sales outside your Territory; however, we will include a listing on our website of your Fly Fitness outlet location. Your local advertising must target customers in your Territory, although the reach of your local advertising may extend beyond your Territory.

What This Means (2024 FDD)

According to Fly Fitness's 2024 Franchise Disclosure Document, franchisees are required to focus their local advertising efforts on customers within their designated territory. While the advertising's reach may extend beyond the territory, the primary target must be the local customer base. This requirement ensures that franchisees are actively promoting their Fly Fitness outlet within their assigned area, maximizing brand visibility and customer engagement within that specific market.

This advertising strategy aligns with the territorial rights granted to Fly Fitness franchisees. Although the territory is not exclusive, meaning franchisees may face competition from other franchisees, company-owned outlets, or alternative distribution channels, the focus on local advertising helps to establish a strong presence within the franchisee's designated area. By targeting local customers, franchisees can build relationships, increase brand awareness, and drive sales within their territory.

It's important to note that Fly Fitness retains the right to sell products and services through alternative distribution channels, such as retail outlets, captive market locations, and the internet, even within a franchisee's territory. Franchisees receive no compensation for these sales. However, the requirement to target local advertising efforts within the territory underscores the importance of the franchisee's role in building a local customer base and promoting the Fly Fitness brand within their community.
