- 21.1.3 Franchisee's Employees.
Franchisor has no authority to control, either directly or indirectly, the essential terms and conditions of employment of Franchisee's employees.
Franchisee acknowledges and agrees that Franchisee, in Franchisee's sole and absolute discretion, shall determine all such essential terms and conditions of employment, which are defined in the Manual.
Franchisee specifically agrees that any training Franchisor provides for Franchisee's employees is geared to impart to those employees, with Franchisee's ultimate authority, the various procedures, protocols, systems, and operations of a Fly Fitness Franchise and in no fashion reflects any employment relationship between Franchisor and such employees.

What This Means (2024 FDD)
According to Fly Fitness's 2024 Franchise Disclosure Document, the franchisee is responsible for exercising control over the day-to-day operations of their franchised business. The standards that the franchisee must adhere to when controlling these operations are usually found in the Fly Fitness manual.
Fly Fitness franchisees have the authority to make essential employment decisions for their staff, such as determining terms and conditions of employment. While Fly Fitness may provide training for the franchisee's employees, the franchisee retains ultimate authority over their staff. This training is intended to impart the procedures, protocols, systems, and operations of a Fly Fitness franchise.
Fly Fitness franchisees must employ qualified individuals trained to Fly Fitness's standards. These employees must conduct themselves competently and courteously, in line with the Fly Fitness system's image and reputation. Coaches must also obtain personal training certifications from a nationally recognized organization approved by Fly Fitness within 90 days of hiring and attend continuing education or training programs to maintain their certifications.
