What This Means (2024 FDD)
According to Fly Fitness's 2024 Franchise Disclosure Document, in the event of a disagreement about the contents of the Fly Fitness manual, the master copy maintained by the franchisor will be the controlling document. This means that Fly Fitness franchisees must adhere to the most up-to-date version of the manual as kept by Fly Fitness itself.
This clause is significant for prospective franchisees because it clarifies that the franchisor has the final say on operational standards and procedures. Franchisees must ensure they are always following the guidelines in the franchisor's master copy, even if they have a different version. This could require franchisees to regularly check for updates or clarifications from Fly Fitness to avoid unintentional non-compliance.
Furthermore, if a franchisee loses or misplaces their physical copy of the manual, Fly Fitness may provide a replacement copy at its discretion, but the franchisee will be responsible for paying the then-current replacement fee. This underscores the importance of maintaining and protecting the manual, as it is the definitive guide for operating a Fly Fitness franchise and adhering to the franchisor's standards.
