What This Means (2024 FDD)
According to Fly Fitness's 2024 Franchise Disclosure Document, the Development Agreement does not grant the developer a license to operate a franchised business. The agreement specifically states that it is not a Franchise Agreement and does not grant the developer any right or license to operate a franchised business, distribute any product or service, or use the Fly Fitness marks.
Instead, the Development Agreement grants the developer the right to develop, construct, and open Fly Fitness franchises within a specific Development Area, subject to the terms and conditions outlined in the agreement. To operate a franchised business, the developer must enter into a separate Franchise Agreement with Fly Fitness for each location.
This means that while the Development Agreement secures the developer's right to expand the Fly Fitness brand within a defined area, it does not authorize immediate operation. Each individual Fly Fitness location requires its own Franchise Agreement, ensuring that the developer meets all current requirements and standards before commencing operations at each site.
