Under what circumstances might Flowerama grant permission to relocate a Flowerama Center?

Flowerama Franchise · 2024 FDD

Answer from 2024 FDD Document

If your lease for the premises of the Flowerama Center terminates without your fault, or if the premises are damaged, condemned or otherwise unusable, or if in your and our reasonable judgment there is a change in the character of the location of the Center sufficiently detrimental to its business potential to warrant its relocation, we may grant permission to you to relocate the Center. You may not relocate your Center without our prior written consent, which will not be unreasonably withheld.

What This Means (2024 FDD)

According to Flowerama's 2024 Franchise Disclosure Document, Flowerama may grant a franchisee permission to relocate their Flowerama Center under specific circumstances. These circumstances include the termination of the lease for the premises through no fault of the franchisee, damage to the premises, condemnation of the premises, or if the premises become otherwise unusable.

Additionally, Flowerama may grant permission to relocate if both the franchisee and Flowerama reasonably judge that there is a change in the character of the location that is sufficiently detrimental to the business potential of the Flowerama Center. This determination would warrant relocation.

It is important to note that a franchisee cannot relocate their Flowerama Center without obtaining prior written consent from Flowerama, but Flowerama states that this consent will not be unreasonably withheld. This provision protects the franchisee from being locked into a location that becomes untenable due to unforeseen circumstances, while also allowing Flowerama to maintain control over its brand and network locations.
