What This Means (2024 FDD)
According to the 2024 Flowerama FDD, there are no agreements currently in effect that significantly limit a franchisee's right to use Flowerama's copyrights. Flowerama claims copyrights on certain forms, advertisements, promotional materials, the Flowerama Operations Manual, and the Fruit Bouquets Franchise Operations and Brand Standards Manual.
As a BloomNet Network member, a Flowerama franchisee receives a limited license to use BloomLink or other electronic systems designated for floral order fulfillment and other functions at the Flowerama Center. Besides this exception, franchisees do not automatically receive the right to use items covered by a patent or copyright. However, they can use the proprietary information in the Operations Manual, Fruit Bouquets Franchise Operations and Brand Standards Manual, and other manuals until the Franchise Agreement expires or is terminated, or as otherwise directed by Flowerama.
Flowerama states that a franchisee's and Flowerama's obligations to protect the franchisee's rights to use Flowerama's copyrights are the same as the obligations for the Marks described elsewhere in the Disclosure Document. Franchisees must promptly inform Flowerama of any unauthorized use of their Trade Practices. While Flowerama is not obligated to take action, they may respond as they deem appropriate.
