You will have the right to (a) participate as a member in the FTG System for the purchase of floor coverings and window covering products, and to indicate to the public that your independent business is operated as part of the FTG System; (b) participate in the FTG CashBack Program (see Section 7.2 for details); and (c) adopt and use our selected trademarks, service marks, and trade names with our signs, emblems, and insignia.

What This Means (2025 FDD)
According to the 2025 Floors To Go FDD, as a member of the Floors To Go system, franchisees have the right to participate in the FTG System for purchasing floor and window coverings and to indicate to the public that their business is part of the FTG System. They can also participate in the FTG CashBack Program and use Floors To Go's trademarks, service marks, and trade names with their signs, emblems, and insignia. Franchisees are granted the right to conduct business at a designated location, and this territory is protected from other Floors To Go showrooms. However, franchisees may face competition from other outlets that Floors To Go franchises or owns, or from other channels of distribution or competitive brands Floors To Go controls, including the FTG Shop At Home program.
Floors To Go members are not restricted from selling products for installation outside of their territory or from offering other floor covering or window treatment products for sale alongside those available through the FTG System. Floors To Go will protect and maintain all rights to the "Floors To Go" name and related marks against unauthorized use or challenges. Franchisees must assist Floors To Go in defending these rights and must report any infringements. Floors To Go will indemnify franchisees against claims arising from authorized use of the FTG Marks.
However, franchisees cannot contest Floors To Go's ownership of its trade names, trademarks, trade secrets, or advertising techniques. All rights from the use of Floors To Go's marks benefit Floors To Go, and franchisees must confirm Floors To Go's ownership of these rights. Franchisees must also adhere to Floors To Go's advertising requirements if they develop internet-based advertising and must not interfere with Floors To Go's use of its marks. Franchisees are required to adopt a fictitious trade name incorporating the words "Floors To Go" but cannot incorporate those words into their legal business name.
